Do council rules for garden clearance differ across England?

Checked against official sources, October 2026. This guide uses England as its example. Wales, Scotland and Northern Ireland differ.

Yes. Registration is national and run by the Environment Agency, but every council in England sets its own rules and charges on things like tipping trade waste, permits, protected trees and enforcement.

Where you tip

Some councils let traders use household recycling centres, some charge, some ban trade waste altogether. Many expect you to use a permitted waste transfer station and keep the weighbridge ticket.

Trees and hedges

Trees with a Tree Preservation Order and trees in conservation areas need consent before work. Doing it without can be a criminal offence. Check with the council’s tree officer before cutting anything large.

Skips and parking

Skips on the road, and parking a van or trailer outside a job, can need a permit that varies by council.

Enforcement

Some councils check traders actively and ask for paperwork on the roadside. Others mostly act on complaints.
